EvolveWell Inc. Law Enforcement Policy

Effective Date: 09/01/2024

EvolveWell is dedicated to delivering high-quality health and wellness solutions, utilizing cutting-edge technology to enhance user experience and engagement. We respect the privacy and rights of our users while adhering to the legal frameworks within the jurisdictions we operate.

This Law Enforcement Policy outlines the procedures and guidelines for government and law enforcement agencies that seek information from EvolveWell, in line with our privacy policy and terms of use.

Legal Basis for Cooperation

EvolveWell cooperates in good faith with federal, state, and local law enforcement agencies when they provide a lawfully-issued request, which must be properly served by a sworn officer. To obtain information from EvolveWell, law enforcement officials must present a legal process that is appropriate for the type of information sought, such as a subpoena, court order, or warrant.

We rigorously review all requests to ensure they comply with the law and are limited to what is legally required. EvolveWell reserves the right to challenge or appeal any request for information and will not disclose any information until legally compelled.

User Notice Policy

Our policy is to notify our users of requests for their information and to provide them with an opportunity to object to the disclosure, generally within 7-14 days prior to complying with the request, unless such notification is prohibited by law. In cases where the law prohibits notification, or in emergency situations where delay might increase risk or harm, we may shorten or waive this notice period.

Law enforcement officials who believe that notification might jeopardize an investigation should obtain an appropriate court order that specifically prohibits user notification.

Account Preservation

EvolveWell will preserve account records in connection with official investigations for 90 days, pending our receipt of a formal legal process.

International Legal Process Requirements

As a U.S.-based entity, EvolveWell responds only to valid legal processes issued by U.S. governmental entities or courts and properly served within the United States. International authorities need to proceed through a Mutual Legal Assistance Treaty (MLAT), letter rogatory, or other recognized international legal cooperation mechanisms.

Form of Requests

Law enforcement requests must be specific and clearly identify the desired records. We will object to requests that are vague, overly broad, or burdensome, to the extent permitted by law. Each request must include:

  • Requesting agency name

  • Requesting agent's name and badge/identification number

  • Requesting agent's employer-issued email address

  • Requesting agent's phone contact, including any extension

  • Requesting agent's mailing address (P.O. Boxes are not accepted)

  • Requested response date

Note: Requests for testimony must be personally served on our registered agent for service of process. We do not accept these requests via email or in person.

Emergency Requests

EvolveWell evaluates emergency requests on a case-by-case basis. If there is an imminent danger of death or serious physical injury to any person, and we have information necessary to prevent this harm, we may provide that information in accordance with applicable law. For expedited processing, include "EMERGENCY" in the subject line of your communication.
